Policies and Terms of Service exist for a very good reason but here at Simply Ducky we believe in working with our clients and are able to be flexible in regards to special circumstances or the unexpected.
Terms of Service
Billing
Clients are responsible for keeping their accounts in good standing by settling invoices within the due date. With the exception of some unique work with specifically stated terms, clients by default have Net 30 terms on all invoices.
Clients with overdue invoices will have work paused on their project(s).
An overdue fee after 60 days of 2% per month (26.82% per annum) will be charged on accounts past due.
Account Credits
Any credits on client accounts will be tabulated in hours, at their standard hourly rate.
Credits on account will be held for a period of two years before expiring.
Any credit on account cannot be used to pay for Annual Monitoring.
Force Majeure
Simply Ducky Designs shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.
Some events are beyond our control.
Limitation of Liability
The Client acknowledges and agrees that Simply Ducky Designs will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.
We provide advice to our clients using the highest industry standards and technical knowledge but the online world can change very quickly.
No Guarantee
The client acknowledges and agrees that Simply Ducky Designs cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
We do our very best but the end result of any project is also dependent on you, the client, doing your part.
